A nationwide class action lawsuit has accused Bluetriton of allegedly misleading customers by selling water that allegedly contains microplastics.
The lawsuit was filed on Jan. 23 by named plaintiff Perry Bruno, of Los Angeles, in Los Angeles County Superior Court against Bluetriton Brands Inc. The lawsuit was removed to Los Angeles federal court on Feb. 26.
The lawsuit accuses the company of intentionally misleading customers by labeling its products as 100% Mountain Spring Water when they allegedly also contain microplastics. According to the complaint, microplastics are small plastic particles that originate from manufacturing and physical degradation of plastics. They are not naturally occurring and can leach into water from bottles exposing consumers to additives and unreacted monomers.
The complaint alleges multiple violations of California's Unfair Competition Law.
The plaintiffs seek to expand the action to include potentially everyone in the U.S. who purchased Bluetriton water.
The lawsuit seeks actual damages and punitive damages, plus attorney fees.
The plaintiff's attorneys are Todd M. Friedman and Adrian R. Bacon, from the Law Offices of Todd M. Friedman P.C., of Woodland Hills.
