Energy company Valero Services has been accused of violating California labor law in a class action lawsuit.
The plaintiff, Ernesto Arellano, is representing himself and all other similarly situated current and former employees of Valero Services.
The complaint alleges that the company failed to pay minimum, regular and overtime wages for on-call time. It also accuses the company of not correctly calculating the regular rate and overtime rates of pay, not providing meal and rest periods, as well as waiting time penalties. Furthermore, it alleges that Valero did not keep accurate records and violated various sections of the California Labor Code.
Plaintiffs are seeking unspecified damages and penalties, plus attorney fees.
The lawsuit was filed in December in Los Angeles County Superior Court by attorneys Larry W. Lee, Simon L. Yang from Diversity Law Group P.C., Edward W. Choi from Law Offices of Choi & Associates, and David Lee from David Lee Law APC. It was removed to Los Angeles federal court on Feb. 22.
