Class action accuses trucking firm McLane Foodservice of allegedly shorting OT pay

A class action lawsuit has been filed against McLane Foodservice, Inc., a Texas-based trucking and logistics company, accusing it of violating labor laws by allegedly shorting workers overtime pay. 

The plaintiffs, Jordan Orozco Madero and Esteban Orosco, who are represented by the Desai Law Firm, allege that McLane does not pay its intrastate truck drivers an overtime premium for their overtime hours as required by the Fair Labor Standards Act (FLSA). The case was filed in the U.S. District Court for the Central District of California on Jan. 12.

The complaint alleges that McLane implemented illegal pay procedures that deprived the plaintiffs of proper overtime compensation when they worked more than 40 hours in a week. The plaintiffs are seeking to recover unpaid overtime wages, an additional equal amount as liquidated damages, obtain declaratory relief, and attorney fees.

In addition to the alleged failure to pay overtime compensation, the lawsuit also accuses McLane of failing to issue accurate itemized wage statements, failing to reimburse for work expenses, and unfair business practices under California's Unfair Competition Law.

Plaintiffs are represented by attorneys Aashish Y. Desai and Adrianne De Castro, of the Desai firm, of Costa Mesa.
