Marriott accused in class action of allowing Salesforce to record customer chats

Marriott International is facing a class-action lawsuit for allegedly allowing Salesforce, a marketing communications vendor, to monitor customer interactions on Marriott's online chat system. 

The lawsuit was filed by lead plaintiff Anne Heiting in November in Los Angeles County Superior Court and removed to Los Angeles federal court on Dec. 27.

Heiting and the potential class of additional plaintiffs are represented by attorneys Robert Tauler and Wendy Miele, of the firm of Tauler Smith LLP, of Los Angeles.

The complaint alleges that Marriott violated privacy laws by not informing customers that their online conversations were being recorded and used for commercial surveillance purposes. 

The lawsuit seeks unspecified statutory damages under California privacy and computer data access laws, plus punitive damages and attorney fees.

This case mirrors a similar lawsuit earlier filed by Heiting and her legal team against Athenahealth, an online healthcare networking vendor.
