Class action accuses Homeagain.com of surreptitiously installing spyware on users' devices

Homeagain.com, a lost pet reunification site, is facing a class action lawsuit for allegedly installing spyware on users' devices without their consent. 

The lawsuit accuses the company of violating California law. It was initially filed in Los Angeles County Superior Court in November. However, it was removed by defendants to Los Angeles federal court on Dec. 27.

The plaintiff, Jerry Aviles, alleges that Homeagain.com secretly deployed spyware to identify anonymous visitors and monitor their online habits to allegedly use that information for profit. 

The complaint identifies Aviles as a "privacy advocate" who works as a "tester" to help trial lawyers identify target companies to sue.

The complaint states that this tracking software was installed on Aviles' mobile device when he visited the website in 2023, without his knowledge or consent.

The lawsuit argues that Homeagain.com is subject to jurisdiction in California under state law, even if computers are accessed from outside California.

The lawsuit seeks to expand the action to include all California residents who visited Homeagain's site.

The plaintiffs are represented by attorney Scott J. Ferrell, of Pacific Trial Attorneys, of Newport Beach.
