Class action: Shambaugh & Sons of shorting worker pay, other alleged CA labor code violations

A class action lawsuit accuses Shambaugh & Sons, a Fort Wayne, Indiana-based maker of fire suppression systems, of allegedly shorting worker pay and denying employee meal breaks, among other alleged violations of California labor law. 

The case was filed in Orange County Superior Court in September, and was removed to federal court in the U.S. District Court for the Central District of California on Nov. 22. Shambaugh operates a facility in Brea. 

Employees allegedly were "regularly" required to work shifts of more than five hours without a meal break and more than 10 hours without a second meal break, according to the lawsuit. Also, employees weren't paid for the missed meal breaks, according to the suit.

Employees allegedly were also "systematically not authorized and permitted" to take 10 minute rest periods every four houses, the lawsuit states.

If employees were fired or resigned, they allegedly were not given their final paychecks within 72 hours, the plaintiffs claim. These alleged actions were all violations of the California Labor Code, the lawsuit states.

It seeks restitution for wages allegedly not paid with interest, plus attorney fees and court costs.

The plaintiffs are represented by attorneys James. R. Hawkins, Gregory Mauro, Michael Calvo and Jeanne Sarminento, of James Hawkins APLC, of Irvine.
