PHH Mortgage Services on Nov. 21: 'Sustaining Defendants' Demurrer To Complaint The Court, Having Considered The Moving Papers And Plaintiff's Failure To Oppose, And Good Cause Appearing, Hereby Orders As Follows: 1. Defendants' Request For Judicial Notice Is Granted; 2. Defendants' Demurrer To Complaint Is Sustained; 3. The Court, After Reviewing The Demurrer And Request For Judicial Notice, Concludes That The Causes Of Action In The Complaint Are Time-Barred By The Statute Of Limitations And, Therefore, Leave To Amend Is Denied; 4. Plaintiff's Complaint Is Hereby Dismissed With Prejudice; And 5. Defendants Are Ordered To Prepare And Submit A Proposed Order For Review And Approval. It Is So Ordered.'.
