Class action: Some Lexus model car A/C units too easily clogged by spider webs, insects

Toyota has been hit with a class action lawsuit in federal court, accusing the automaker of selling Lexus model vehicles with a faulty air conditioner part that is susceptible to breaking down when they become clogged by spider webs or insect incursions.  

The alleged problem is caused by "a defectively designed" air conditioner evaporator drain, according to the lawsuit, filed in U.S. District Court for the Central District of California.

"Both the design and materials’ deficiencies of the AC evaporator drain make it highly susceptible to damaging blockages caused by spider

webs and other insect structures," the suit says. " The blockages prevent the water associated with an air conditioning system from draining outside the vehicle, thus causing the water to drain inside the passenger compartment."

The drainage problem in turn causes other problems inside the car, the lawsuit states.

"The water creates damage and a moist, hospitable environment for the growth of bacteria, fungus, mold, and spores, which then are blown into the passenger compartment," the suit alleges. "This causes the air to have a foul, mildewy smell that is highly unpleasant and can cause

respiratory problems and aggravate allergies."

The suit seeks monetary damages with interest, plus attorney fees.

The plaintiffs are represented by S. Martin Keleti of Keleti Law, of Beverly Hills; Gary S. Graifman, of Kantrowitz, Goldhamer & Graifman P.C., of Montvale, New Jersey; and Thomas P. Sobran, of Thomas P. Sobran P.C., of Hingham, Massachusetts.
