A woman has filed a federal lawsuit suit against the city of Los Angeles, claiming police mistreated her when they responded to her home after her boyfriend, with whom she is in an "open relationship," called the cops when she allegedly refused to let him leave the house for a date with another woman.
The alleged incident occurred February 3, in Pacoima, according to the lawsuit filed by Evalyn Martinez in Los Angeles federal court.
According to the complaint, Martinez and her boyfriend were arguing about her boyfriend going on a date with another woman.
It allegedly resulted in Martinez "blocking (the boyfriend's) exit from the front door of Plaintiff’s residence," the lawsuit states. "Plaintiff instructed (the boyfriend) to climb out of the floor level window if he wanted to leave the house."
Instead, the boyfriend called Los Angeles police who instructed the boyfriend to climb out of the floor level window because Martinez still had the front door of the house blocked, the lawsuit stated.
Martinez allegedly told police officers to leave her house, "as she had not done anything wrong and wanted to shut the window to her residence," the suit says.
Police allegedly then pulled Martinez through the window and "threw her onto the ground," according to the lawsuit.
Martinez was taken to a hospital where she was treated hereafter taken to the hospital, and treated for a concussion, a sprained elbow, dislocated arm, nerve damage, and knee damage, and then arrested, the suit said.
She seeks damages and attorney fees.
