Class action: Thermomix multicooker maker of selling defective product

 A class action lawsuit accuses the maker of the Thermomix multicooker of selling a product that has allegedly burned users by unexpectedly spewing boiling hot liquid while cooking.    

"A defect in the lid of the TM6 caused the scolding hot liquid to shoot in all directions," says the lawsuit,  filed in Los Angeles County Superior Court. "This defect exists in all TM6 models sold to the class, and is a design and manufacturing defect."

The lawsuit was removed to federal court in the U.S. District Court for the Central District of California in Los Angeles on Nov. 9.

The partner of the lead plaintiff, Eduardo Cruz, of Studio City, was allegedly severely burned by the product on  Nov. 12, 2021 while cooking with the product, the suit said.

The TM6 has a removal measuring cup in the center of the lid, which is "connected to the lid only by gravity," the lawsuit states.

"Any amount of insignificant pressure or force from inside the product causes the cap to come off," the suit states. "When the cap is removed, there is an open hole in the top of the product, allowing burning hot liquid to shoot out of the top when the blender function begins."

The suit seeks financial restitution, plus attorney fees.

The plaintiffs are represented by attorneys R. Alexander Comley and Stephen E. Fresch, of Comley Fresch, of West Hollywood, and Donald R. Pepperman, of Waymaker LLP, of Los Angeles.
