Marriott Resorts Hospitality Corporation on May 22: 'Order Filed. This Matter Was Argued On May 8, 2023, And Submission Was Deferred Pending Resolution Of A Statutory Interpretation Question By The California Supreme Court. In His Complaint, Riojas Alleges That Marriott Violated The Whistleblower Retaliation Statute (lab. Code, § 1102.5) When It Fired Him After He Complained About Facing Age Discrimination And Retaliation, And After He Reported What He Reasonably Believed To Be Unsafe Working Conditions (workers Operating Company Vehicles Without A Commercial Driver's License). (ct 41-42.) The Supreme Court Has Now Clarified The Types Of Disclosures Protected Under Labor Code Section 1102.5. (people Ex Rel. Garcia-Brower V. Kolla's Inc. (may 22, 2023, S269456).) We Accordingly Invite The Parties To Submit Supplemental Letter Briefs, Limited To Three Pages In Length Single Spaced, Discussing The Impact, If Any, Of Kollas' On The Merits Of Riojas's Whistleblower Retaliation Claim. Riojas Is To Submit His Supplemental Letter Brief On Or Before May 30, 2023. Marriott May Submit Any Responsive Supplemental Letter Brief Within One Week After Riojas Files His Brief.
