Ian Stewart (Partner-Los Angeles, CA) will speak on “The Future of Cannabis Product Risk Management and Insurance” at the RIMS 2023 RISKWORLD conference to be held April 30–May 3, 2023, in Atlanta, Georgia. Ian will provide context around how cannabis claims have developed, how future toxic tort–style litigation may present an enormous challenge to the cannabis industry, and how the insurance industry is responding to current and future cannabis product risks. He will discuss how traditional and new alternative insurance models, such as captives and RRGs, will help bear future risks. Other risks, for example, from widespread testing lab failures and the eventual collision between interstate commerce and intrastate cannabis regulator structures, will result in additional legal uncertainty and compliance hurdles. Ian suggests this all may be a recipe for potential tort liability that is presently unseen by the cannabis industry – and the insurance companies that insure it.
