New California Developments and a Few Updates on January 31, 2023

The legal landscape for California employers continues to evolve through legislative and regulatory developments. In January, the California Labor Commissioner’s Office released new FAQs clarifying the California Equal Pay Act’s pay scale transparency requirements that became effective on January 1, 2023. The California Civil Rights Department also updated its FAQs for the revised California pay data reporting requirements that go into effect this year. We’ll also review California employer obligations for consumer privacy under the CCPA and the CPRA and under the permanent COVID-19 standard passed by the Cal/OSHA Standards Board on December 15, 2022. Finally, we’ll discuss the impact of the Federal Trade Commission’s possible ban on non-competes on California employers and provide an overview of the federal religious accommodation standard that the U.S. Supreme Court has agreed to review and what a change in that standard would mean for California employers.
