Woman sues for legal malpractice of former lawyer in wrongful death suit

FRESNO -- A woman claims that her former lawyer is guilty of legal malpractice and breach of contract. 

Karen Kilburn filed a complaint on June 14 in Fresno County Superior Court against Quinlan, Kershaw and Fanucchi for legal malpractice and breach of contract. 

According to the complaint, David Michael Moeck, an attorney with Quinlan, was hired to represent Kilburn as Executrix of the estate of Kent Kilburn in a wrongful death lawsuit. 

Karen Kilburn alleges that between Dec. 5, 2018, and March 18, 2019, Moeck performed various legal services in connection to the case. On Jan. 8, 2019, Kilburn inquired about the standings of the case and Moeck stated that a complaint was being drafted, the suit says.

On Feb. 12, 2019, Moeck drafted the complaint, yet by March 18, 2019, the complaint had not been filed while Moeck ensured Kilburn that her case was being handled professionally, the suit says. Moeck continued to represent Kilburn until March 23, 2019, when Moeck informed Kilburn that the statute of limitations had expired.

Kilburn seeks actual and special damages and cost of suit. Kilburn is represented by James S. Rummonds of Rummonds Law Firm.
