Man sues City of Fresno and officer for alleged false arrest

FRESNO -- A man is suing the City of Fresno and police officers after allegedly being subjected to false incarceration.

Thomas Miller filed his lawsuit on May 4 in Fresno Superior Court against the City of Fresno and Officer V. Barrios and Does 1-10 for false arrest/false imprisonment, battery and negligence. 

According to the complaint, on May 10, 2020, Miller was waiting at a Waffle Shop restaurant when he V. Barrios, an officer of the Fresno Police Department, appeared and began making his way through the business, then placed Miller in handcuffs and placed him in the back of a patrol vehicle for approximately 45 minutes in 90 degree weather with the windows rolled up and the car off. 

Miller also alleges that he sustained injuries to his wrists from the handcuffs. 

Miller seeks compensatory damages, punitive damages and cost of the suit. Miller is represented by Nathan S. Miller of Miller & Ayala, LLP.
