Naval Medical Center San Diego sued over newborn's brain damage

SAN DIEGO - The mother of a minor child is suing the U.S. government for medical negligence under the Federal Tort Claims Act in relation to an incident that took place at the Naval Medical Center San Diego in August 2018.

The suit was filed April 21 by attorney John Gomez of Gomez Trial Attorneys on behalf of Georgia resident Kiara McKnight in the U.S. District Court for the Southern District of California.

The suit alleges that, on August 28, 2018, McKnight was in labor at the medical center, and that following delivery of her child medical center staff failed to respond to multiple signs her child was in distress, resulting in permanent brain damage in the infant. It also alleges that staff failed to perform a timely C-section on McKnight.

McKnight is alleged to have been approximately eight months pregnant at the time labor was induced at the medical center. Despite being connected to a monitor that showed constant updates of the fetal heart rate, the suit alleges that medical personnel missed changes in the conditions of the fetus and did not take appropriate actions then or after the birth when complications were discovered.

McKnight is seeking actual damages, costs and interest.
