Chula Vista man blames Amtrak for incident that caused injuries on passenger train

SAN DIEGO - A Chula Vista man sued the National Railroad Passenger Corporation (NRPC) after he was injured while riding a passenger train that came to a sudden halt, according to documents filed in January in the San Diego County Superior Court. 

Plaintiff Arthur Javier says he was on an Amtrak passenger train on Aug.15, 2019, on the Common Carrier north of the San Juan Capistrano train station. 

Javier alleges that the train came to a sudden, unexpected halt because NRPC construction crews were working on or near the tracks ahead. Despite being properly seated in accordance with the train's regulations, Javier was allegedly violently thrusted forward and was injured.

NRPC is sued with negligence and the plaintiff requests general and special damages, litigation fees and other judgments deemed appropriate. 

Javier is represented by the Jurewitz Law Group. The defendant removed the case to San Diego federal court in March.
