'Order Filed. In This Matter, The Trial Court Entered An Unsigned Minute Order Dismissingthe Action Without Prejudice In January 2019. According To Code Of Civil Proceduresection 581d: "all Dismissals Ordered By The Court Shall Be In The Form Of A Written Ordersigned By The Court And Filed In The Action And Those Orders When So Filed Shall Constitutejudgments And Be Effective For All Purposes, And The Clerk Shall Note Those Judgments Inthe Register Of Actions In The Case." A Signed Order Of Dismissal Pursuant To Section 581ddoes Not Appear In The Clerk's Transcript Or In The Superior Court's Register Of Actions. As Aconsequence, It Appears The Action Might Not Have Been Dismissed In The Trial Court.at Oral Argument, The Parties Should Be Prepared To Address (1) Whetherthere Is A Signed Order Of Dismissal Filed In This Matter, And (2) The Effect Of The Lack Of Asigned Order Of Dismissal On Appellate Jurisdiction.
