The National Law Journal (NLJ) has named Jones Day partner Daniel D. McMillan to the inaugural list of Real Estate/Construction Law Trailblazers. Through the various Trailblazers special supplements, the NLJ recognizes movers and shakers in the legal industry who have made an impact in their sectors through new types of strategies or innovative court cases.
Mr. McMillan represents clients responsible for major construction programs and projects that transform communities. NLJ recognized Mr. McMillan as a Trailblazer for his rare combination of skills as a trial lawyer and transactional attorney, capable of fashioning practical solutions to the most difficult challenges facing the construction industry. He is a recognized leader in the construction industry with Fortune 500 project owners, contractors, design professionals, and public entities turning to him for his trusted advice on the largest and most complex projects located in California, throughout the United States, and across the globe.
The NLJ highlighted a number of recent high profile matters handled by Mr. McMillan. He was recognized as a Trailblazer for a number of recent litigations, including spearheading the defense in litigation concerning the Millennium Tower (aka "the leaning Tower of San Francisco"), a high-profile billion-dollar lawsuit involving a prominent 58-story condominium tower that has sunk more than 17 inches. When a major school district embarked on $20 billion in bond-funded construction, the largest K-12 school construction program in the country's history, the district chose Mr. McMillan as construction counsel to advise the program and develop the district's first ever design-build contracts. He recently prevailed in federal court on a question of first impression under the False Claims Act on behalf of executives of a Fortune 500 construction firm who had been named in a retaliation lawsuit by a terminated subcontractor. And, when legal challenges were filed against a Los Angeles County ballot measure that would generate more than $120 billion to fund transportation construction projects, including multibillion-dollar subway extensions needed before the 2028 Summer Olympics, the Los Angeles County Transportation Authority relied on Mr. McMillan to win the case.
As co-leader of the Firm's global Construction Practice, Mr. McMillan represents owners, design professionals, and contractors in large construction disputes and in negotiating and drafting the full panoply of contracts for large projects. He is a frequent speaker and writer on issues of interest to the construction industry and the legal profession.
