The 2018 California Supreme Court Dynamex decision and AB 5 (Gonzalez) target the misclassification of workers and severely restrict the use of independent contractors in California. AB 5 that becomes law on January 1, 2020 has serious implications for the long term care profession, including skilled-nursing facilities and intermediate-care facilities for people with intellectual disabilities. AB 5 will significantly affect the way long term care facilities run their day-to-day business operations.
